1. Definitions

“Postidal Inc.” includes all subsidiaries, affiliates, divisions, contractors, franchisees, and related entities, collectively referred to as “Postidal Entities.” “Customer” includes any sender, recipient, account holder, or third party using Postidal services.

2. Scope of Services

Postidal provides nationwide package pickup, transport, logistics, and delivery. All services are subject to operational capacity, regulatory compliance, and safety requirements.

3. User Eligibility & Account Responsibilities

Customers must provide accurate information, maintain secure account credentials, and comply with all applicable laws. Postidal may suspend or terminate accounts for misuse, fraud, or non‑payment.

4. Shipment Acceptance & Restrictions

Postidal may refuse or cancel shipments that are illegal, hazardous, improperly packaged, or pose safety risks. Compliance with DOT, TSA, USPS, FAA, and state regulations is mandatory.

5. Packaging & Labeling Requirements

Customers are solely responsible for proper packaging. Postidal is not liable for damage caused by inadequate packaging, improper labeling, or failure to follow guidelines.

6. Pickup, Transport & Delivery

Delivery times are estimates only. Postidal may attempt delivery multiple times or hold packages for pickup. Unclaimed packages may incur storage fees or be deemed abandoned.

7. Risk of Loss, Title Transfer & Inspection

Risk of loss transfers to the Customer when Postidal accepts the shipment for transport. Customers must inspect packages immediately upon delivery and report issues within 90 days.

8. Liability Limitations

Postidal’s maximum liability is not higher than the item’s purchased value, unless additional declared value is purchased. Postidal Entities are not liable for consequential or punitive damages, lost profits, delays caused by weather or regulatory inspections, improper packaging, or acts of God.

9. Insurance & Declared Value

Customers may purchase additional declared‑value coverage. Declared value is not insurance and does not guarantee replacement cost.

10. Prohibited Items

Postidal prohibits hazardous materials, illegal goods, perishables requiring refrigeration, cash, jewelry, or high‑value items without declared value.

11. Fees, Billing & Payment Terms

All fees must be paid before shipment unless otherwise agreed. Postidal may withhold delivery for unpaid balances.

12. Fraud Prevention & Security Measures

Postidal may verify identity, require signatures, use GPS tracking, and cooperate with law enforcement. Suspicious activity may result in cancellation or legal action.

13. Data Usage & Privacy

Postidal may use shipment data for operational purposes, fraud prevention, and regulatory compliance. Data is handled in accordance with applicable privacy laws.

14. Indemnification

Customers agree to indemnify Postidal Inc. and all subsidiaries against claims arising from illegal shipments, improper packaging, misuse of services, or customer negligence.

15. Limitation of Actions & Claims Process

Claims must be submitted within 90 days of delivery. Legal actions must be filed within one year of the event giving rise to the claim.

16. Force Majeure

Postidal is not liable for delays or failures caused by events beyond its control, including natural disasters, labor strikes, or government actions.

17. Governing Law

These Terms are governed by the laws of the State of New York, unless federal law requires otherwise.

18. Mandatory Arbitration & Class‑Action Waiver

All disputes must be resolved through binding arbitration. Customers waive the right to participate in class actions or collective lawsuits.

19. Subsidiary & Affiliate Protections

All Postidal Entities benefit from the liability limitations and dispute‑resolution provisions in these Terms. Claims must be directed to Postidal Inc. as the primary contracting entity.

20. Modifications to Terms

Postidal may update these Terms at any time. Continued use of services constitutes acceptance of updated Terms.

21. Severability

If any provision is invalid, the remaining provisions remain enforceable.
